APPELLATE SUCCESS FOR COHEN and BODO, LLC.
The Law Firm of Cohen and Bodo filed an Appeal last year in the First District Appellate Court (First District) on behalf of an injured CTA commuter and his wife after the presiding Cook County Circuit Court Judge disposed of the Plaintiffs’ case by granting summary judgment in favor of the Defendants. The attorneys at Cohen and Bodo researched and filed a lengthy brief demanding that the dismissal be reversed to allow their clients to present the case to a jury. The Illinois Trial Lawyers Association joined the Plaintiffs and filed an Amicus Brief in support of their position on appeal.
After all briefs were filed in the Appellate Court, the Justices took the unusual step of granting Cohen and Bodo’s request for oral argument in the case. On June 3, 2015 the attorneys from Cohen and Bodo appeared before the First District Appellate Court and presented oral argument before the Justices of the Appellate Court. Among the many spectators in attendance, a representative for the Illinois Trial Association was also present to observe the proceedings.
On June 22, 2015 the Court filed its decision in favor of the injured Chicago resident and against the CTA, thereby reversing the ruling of the circuit court and allowing the injured Plaintiff to present his case to a jury.
